Terms and Conditions Free Web Vulnerability Scan
This agreement governs the Web Security Audit service provided by Acunetix Ltd. You duly authorise Acunetix to conduct the free security audit on behalf of Abraxax BV. The scan results will be sent to
you and to Abraxax BV. By clicking on the Accept button at the bottom of this form, you accept this agreement and agree to be legally bound by it.
1. Application
This agreement establishes the terms and conditions of the Acunetix Web Security Audit Service. The Acunetix Web Security Audit Service provides a high standard scan of the customers web
site, in order to present an indicative list of high level vulnerabilities contained in the web site. The Acunetix Web Security Audit Service will be provided to the Customer at no charge.
2. Scope
The Acunetix Web Security Audit Service is a high level audit, intended to broadly identify web security concerns; it is not a complete web security audit. The Acunetix Web Security Audit
Service is performed remotely, in a semi automated manner. The Acunetix Web Security Audit Service will not provide Customer with an exhaustive list of security risks nor is it intended to meet evaluation standard
levels established by ISO 15408-1 or the Common Criteria equivalent.
The Acunetix Web Security Audit Service contains only an overview of Customers public environment and Acunetix Ltd. will make no suggestions as
to any possible solutions or fixes to security issues found.
3. Customer Responsibilities
3.1 The Customers contact person explicitly guarantees that he is authorized to allow Acunetix Ltd. to scan Customers web site. Customers contact person will approve, coordinate
and cooperate with Acunetix Ltd.s network and systems operations staff when providing the Acunetix Web Security Audit Service.
3.2 The Customers contact person will provide any relevant infrastructure and network data & operating system information required for the Acunetix Web Security Audit to Acunetix Ltd.
3.3 Responsibility to ensure that all necessary and appropriate disaster recovery systems and methods (such as backup, restore and archival) are in place and are functioning properly prior to the Acunetix Web
Security Audit Service, lies solely in the hands of Customer personnel. Customer is obliged to agree to perform suitable backups on a regular basis prior to Acunetix Ltd. providing the Acunetix Web Security Audit
Service.
4. Customer Acknowledgement
4.1 Customer understands and acknowledges that the Acunetix Web Security Audit Service will will not provide Customer with an exhaustive list of security risks be will provide a
preliminary, top-level audit of Customers web site intended to identify currently known vulnerabilities.
Customer will not hold Acunetix Ltd. responsible for failure to discover all security risks and issues that
may exist in Customers current public environment.
4.2 Customer recognizes that providing thorough back-up of data and software is essential to prevent risks associated with the use of computer products: loss, damage, corruption or mis-transmission of stored data on
the web site.
5. No guarantee of accuracy
As the Acunetix Web Security Audit Service is a top-level scan, Acunetix Ltd., makes no guarantees that all vulnerabilities will be discovered.
6. Results
Acunetix Ltd. will provide Customer with a high-level report of the web site security audit.
7. Warranty
Acunetix Ltd. warrants that it will provide the Acunetix Web Security Audit Service to Customer in good faith.
8. ACUNETIX LTD and ABRAXAX BV DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE ACUNETIX WEB SECURITY AUDIT SERVICE.
9. Limitations on Liability and Damages
9.1 In no event shall Acunetix Ltd and Abraxax be liable for any indirect, incidental, special, or consequential damages, or damages for loss of profits, revenue,
data or use, incurred by either party or any third party, whether in an action in contract or tort, even if other party or any other person has been advised of the possibility of such damages.
9.2 Acunetix Ltd and Abraxax will hold no liability for any damage that might result from this test, any way, direct or indirect.
9.3 The limitations on and exclusion of liability for damages set forth above apply regardless of whether the liability is based on breach of contract, tort (including negligence), strict liability, breach of
warranties, or any other legal theory.
